The State Animal Welfare Board, Assam has been constituted
by the Government of Assam in compliance with the Hon’ble Supreme Court’s
order dated 06/08/2008 under
Writ Petition (Civil) 440/2000, ensuring effective
implementation of the
Prevention of Cruelty to Animals Act, 1960,
within the state.
The SAWB, Assam has been reconstituted in 2014, 2020, and 2023 to strengthen animal
welfare administration across Assam.
- 1. The Prevention of Cruelty to Animals Act, 1960, under which the Animal Welfare Board of India functions, does not have an express provision for State Animal Welfare Boards; however, the Supreme Court directed all States and Union Territories to constitute SAWBs for effective implementation of animal welfare laws.
- 2. The Hon’ble Supreme Court in its order dated 06/08/2008 stated:
"We direct the States, which have not constituted the State Animal Welfare Boards to constitute within a period of three months and also to see that the Society for Prevention of Cruelty to Animals (SPCAs) be also constituted in every district as contemplated under the Rules."
- 3. In pursuance of this directive, the State of Assam constituted the State Animal Welfare Board via
Government Notification No. VFV 292/96/182 dated 09th March, 2009.
- 4. The SAWB Assam has been reconstituted subsequently in 2014, 2020, and 2023 to ensure continuity and effective
functioning in line with the objectives of the PCA Act, 1960.
- 5. To provide a legal entity to the State Animal Welfare Board, steps have been initiated for registration under the Societies Registration Act, 1860, enabling it to:
- Receive and manage grants and donations.
- Legally transact with government bodies and the Animal Welfare Board of India.
- Allocate funds to District SPCAs for welfare activities, including infirmary construction and rescue shelter operations
- 6. This registration under the Societies Registration Act, 1860, is seen as essential for the SAWB Assam to function effectively and to discharge its duties towards the enforcement of animal welfare laws in the state.
